The Shindleman brothers – Sandy and Robert – want controversial blogger Gordon Warren to go to jail for contempt of court.

At a hearing this morning, the Shindlemans’ lawyer, Robert Tapper, argued that Warren had repeatedly breached terms of an injunction issued verbally April 8 that prohibits him from communicating in any form about the Shindlemans or their business interests.

However, Tapper said Warren continued to post on his blog about the Shindlemans, had links to other blogs about the local developers, and even reposted the controversial poster that linked several local business people by name, including Sandy and Robert Shindleman, as being involved in a criminal conspiracy with Mayor Sam Katz to steal money from city hall.

The Shindlemans are asking the court to find Warren in contempt of court and to send him to jail for six months and seize his computer.

"This has to stop and this (sending Warren to jail) is the only way to stop it," Tapper told the court.

Warren, who is representing himself, told the court he misunderstood the terms of the verbal order issued by Justice Glenn Joyal April 8 and he didn’t receive a copy of the April 24 written order until late May.

Warren said he has tried to comply with the order but added that the Shindlemans only want to punish him and send him to jail.

Warren said that if Joyal is considering sending him to jail, then the court is required, by law, to appoint a lawyer to represent him before that happens.

Warren said he’s been unable to get a lawyer to represent him on his own: he has been turned down by Legal Aid, and is on a disability pension and cannot afford to hire a lawyer even if he could find one willing to represent him.

Justice Joyal has reserved a decision on the case.

The injunction is part of the Shindlemans’ defamation suit against Warren for publishing allegations about them on his blog.
