Trio sentenced in violent home invasion

Three men have been sentenced for their roles in a violent home invasion that ended with a deadly stabbing.

Jonathon Boyer, 27, Roland Klyne, 28 and Bradley Campbell, 33, pleaded guilty to manslaughter for the April 2010 killing of Ricky Lathlin, 34, inside a Gilbert Avenue residence. They were originally charged with second-degree murder but struck a deal to plead guilty to a less serious charge.

Boyer was sentenced Monday to nine-and-a-half years in prison Monday, while Klyne and Campbell were given eight years behind bars. Those penalties include pre-trial custody, which was given double-time credit because it pre-dates legislative changes outlawing the practice.

Two other accused remain before the courts. James Henry, 40, and Terry Davis, 33.

Crown attorney Tim Chudy told court the men stormed inside the Manitoba Housing complex with a plan to rob a known 17-year-old drug dealer of marijuana. Boyer was armed with a knife and slashed Lathlin in the leg when he tried to defend the property from the intruders. The accused drug dealer was the younger brother of Lathlin’s girlfriend.

"It’s an absolute tragic set of circumstances. He stood up to the people who entered the household... and paid a supreme price for that," Chudy said Monday. The knife severed an artery, and Lathlin bled to death, court was told.

Boyer was given a stiffer sentence because he was the one who actually inflicted the damage while the other men were "parties" to the offence, said Chudy.

Campbell has repeatedly frustrated justice officials since his arrest by refusing to hire a lawyer and claiming he is exempt from Canadian law. "Domestic law is not applicable to Indians," Campbell said in a hearing last year. "I’m being held captive in a foreign court under duress."

Lathlin was survived by two young children. Neighbours described him as a funny, good-natured man who was popular with Gilbert Park children but struggled with alcohol.
