Bombers sue over cancelled Aerosmith concert
Because Aerosmith didn't walk this way at CanadInns Stadium this summer, the Winnipeg Football Club has decided to tackle the promoter with a lawsuit.
Bob Sokalski, the club's lawyer, said Monday the lawsuit is not the same old song and dance -- the club is out actual cash because of the non-concert last Aug. 7.
Sokalski said the club had already spent $97,392.47 for expenses like facility conversion and staffing before the show was cancelled.
As well, Sokalski said the club is also suing for general damages because it lost out on its share of concession sales, parking fees, ticketing commissions and the $4 per ticket facility fee.
"Keystone (Entertainment Group Ltd.) owed an obligation to the football club," he said.
"There's a contract there. The football club has sustained damages because of this breach of contract.
"Keystone made some promises it did not fulfil. Our claim is not with the band, it's with Keystone."
Just two days before the Winnipeg show, Tyler fell off the stage during a performance in South Dakota on Aug. 5, and broke his shoulder and injured his head and neck.
The band cancelled the rest of its tour of Western Canada, which had also featured ZZ Top.
In fact, fans of the band still have to dream on because it's still not back in the saddle, with no new tour scheduled.
Bryan Taylor, the Calgary-based Keystone's president, could not be reached for comment.
The allegations have not been proven in court and no statement of defence has been filed.

This is all really a moot point. If anyone is in trouble of being blacklisted its Keystone. Venue's will be less likely to open their doors in the future for a promoter that won't buy insurance and pay up when their band cancels. The bombers are on the hook as of right now for all the man hours required to setup and take down the massive stage and rig. That cost would have been covered by consessions and ticket sales but when the band doesn't show the bills still have to be paid and that is on the promoter to ensure that insurance is purchased. They may chose to not to purchase insurance so they can make more money but the loses need to be felt by keystone and not the venue. hence the lawsuit.
case in point. the wpg fire dpt does not have insurance. They put money into an acount and if something happens like a punk steels a truck and wrecks it. They are on the hook to pay out of that fund. normally it works out but in strange cases it doesn't. Keystone may have taken a gamble but they got caught and now they are going to have to cough up the doe

If the Bombers spent money getting the stadium ready, the promoter is liable. Why should the Bombers be out money for this. Its not their fault either. If you sign all the paper work for a car and plate it, well guess what its too late you own it. The Bombers are out of pocket, the other guy owes them money, No one does all this work and spend money not to be paid for it. The bombers will win. however, it will be settled long before any court date.

Couldn't we get a look-a-like band to lipsync or even play Aerosmith's songs. I wish that's what they'de done for the Super Bowl. Roger Daltry and Pete Townsend are over the hill and can't sing like they used to just like Tyler can't seem to walk and sing at the same time anymore. Their music used to be great and now they're milking their has-been fame for all it's worth.

Keystone had no choice but to cancel the show. The whole tour got axed
because of Tylers accident. It is unfortunate he fell off the stage while
performing at Sturgis. This is why there is a thing called INSURANCE. In
all reality I was surprised the show wasn't called off due to lack of
tickets sold for the show. Wasn't there less than 5000 seats sold?

Anyone know the kind of pain he is going thru, considering that this gentleman also is a recovering addict. The bombers should have some consideration for this gentleman and keep in touch with keystone to find out when Tyler is feeling better to set up another concert. Tyler really isn't a spring chicken any more. Give the poor guy a break. Keystone can not do anything until Tyler gives the go ahead. Nice to see everyones perspectives are in order

This sounds like a great way to make sure the band decides to drop us from the next tour. The lawsuit will probably be in our favour. But it will probably result in a blacklisting of our venue. Yes. We lost money on circumstance. I don't know how it works. But money must change hands some where. I don't know if the band "rents" the space and keeps the profits or we pay the band to come and keep some profits from ticket sales. But if money changes hands, can't we just negotiate for $100k more to come our way instead of legal action that could seriously damage our venue reputation?
