Interim injunction bid reset for April

The writer of an Internet blog whose postings have been called everything from hate crimes to anti-Semitic and defamatory said he welcomes a court fight to clear his name.

Gordon Warren stood in the ground-floor hallway of the Law Courts building late Tuesday morning and laughed as he reviewed the material he said has been given to the court to prove his writings have defamed brothers Sandy and Robert Shindleman, two local businessmen.

"This material is just a dog's breakfast," said Warren, 48. "They've walked into my trap. I've got them jumping like a jitterbug."

Warren went to court Tuesday to oppose an application by the Shindlemans for an interim injunction that would stop him from communicating in any way about them or their business, Shindico Realty.

The morning hearing was adjourned to early April after the presiding judge refused to hear any arguments, saying the session was reserved for uncontested or unchallenged motions.

"They think I'm a dummy," Warren said. "I have a master's degree in theology from the University of Winnipeg.

"I may not seem like much, but I know what I'm doing and I'm going to do it."

Warren has repeatedly made accusations against the Shindleman brothers, Mayor Sam Katz and several other prominent business people, all but one of whom are Jewish. He has made the accusations on his Internet blog, on posters in the downtown area and in emails.

He said Winnipeg police have questioned him several times and decided not to charge him with hate crimes. He said materials included in the application for the interim injunction include excerpts of translations from the Babylonian Talmud, a written codification of Judaic oral law that dates back to 500 CE.

Warren denied his writings are defamatory, anti-Semitic or constitute hate crimes, adding his postings repeat what has been produced by mainstream media.

He said he is currently unemployed, adding his probe into corruption at city hall is taking up all his time.

Lawyer Robert Tapper, who represents the Shindlemans, told Justice Donald Bryk it is imperative he issue an interim injunction immediately.

Tapper said Warren's writings refer to the Holocaust and describe the Shindlemans as cockroaches and criminals. He said Warren is expected to continue writing about the Shindlemans in the same manner.

Warren told the court he planned to oppose the interim injunction, but added he had no material or evidence of his own to present.

"I believe Mr. Tapper has brought enough material for the both of us," Warren told the court.

Bryk said an injunction to stop Warren from communicating should only be given in exceptional circumstances and he wasn't able or prepared to make such an order Tuesday morning. He said he would not be available to hear arguments this week.

Tapper requested a brief adjournment to find another judge willing to hear the case later in the day or today. He returned with confirmation another Queen's Bench judge will hear his application this morning.

However, that date was also scrubbed a few hours later. The new date for the hearing on the interim injunction application is April 8.

The Shindlemans believe Warren will use the defamation claim against him to further attack them, and they want an interim injunction until the defamation case is decided in court.

Warren said he's been demonized for his writings and as a result has been unable to hire a lawyer.

"No one will take on my case," Warren said.

"One (lawyer) even wrote me a letter and said I was Hitler incarnate."
