Hotel room standoff gets gang member 4.5 years in prison

A high-ranking Winnipeg gang member has been sentenced to four and a half years in prison for hiding out in a city hotel with a loaded handgun.

Gene Malcolm admitted Tuesday to tossing the firearm out the window of a room at the Greenwood Inn and Suites during a police stakeout last November. Officers had been tipped off that Malcolm was inside the Wellington Avenue hotel with the weapon. They surrounded the premises, ordered Malcolm to ditch the gun and come out. He eventually complied and there were no injuries.

Malcolm, 28, is connected to the M.O.B street gang, which has been at odds with the Indian Posse gang for the past couple of years, court was told. Malcolm has an extensive criminal history and was critically injured in 2003 after repeatedly being shot during a home invasion as part of an internal gang dispute.

Defence lawyer Barry Sinder said Malcolm has been understandably paranoid as a result of the attack and his continued gang involvement.

Malcolm faced a mandatory minimum sentence of three years under federal weapons legislation, but Crown and defence lawyers made a joint-recommendation for a longer sentence based on the circumstances of the case -- including the fact Malcolm was previously given a lifetime ban from owning firearms.
