Man gets 7 years for killing abusive half-brother

A Winnipeg man has been sentenced to seven years in prison for stabbing his abusive half-brother to death.

Sesar Edgardo Romero, 24, pleaded guilty to manslaughter for the August 2010 killing of Nathan Kayseass, 24. The Crown dropped a more serious charge of second-degree murder, which carries a mandatory life sentence with no chance of parole for at least 10 years.

Romero was extremely intoxicated when he plunged a butcher knife into the victim at least three times inside their Manitoba Housing unit in the 1400 block of Winnipeg Avenue. Kayseass was rushed to hospital but died several hours later.

Romero has no prior criminal record and was subjected to years of bullying, along with physical and sexual abuse, at the hands of Kayseass, court was told. Romero was struggling with untreated alcohol addiction, which contributed to the deadly attack.

"I believe if you could have dealt with your addiction to alcohol before August 2010, you would not be here today," provincial court Judge Rob Finlayson said Tuesday.

Romero has spent the past two years in pretrial custody without bail, which Finlayson gave extended credit of 27 and a half months for, based on his difficulty in getting access to various programs and treatment.

Romero was then sentenced to serve another four years, eight and a half months behind bars.

Crown and defence lawyers had made a joint-recommendation for a sentence in the range of seven to 10 years on paper.

The mother of both the victim and killer told court Tuesday she was also victimized by Kayseass and still has a visible scar on her forehead from a previous incident. She was away at a religious retreat in Saskatchewan the night of the stabbing.
