Man gets time served for rape of sex trade worker

A Winnipeg man has admitted to raping a sex-trade worker in 2004 in a case that was solved years later, thanks to DNA analysis.

Martin Derksen pleaded guilty to sexual assault -- just as his jury trial was set to begin this week.

He struck a deal with the Crown in which he was sentenced to 11 months of time already served, plus given three years of supervised probation on Wednesday.

Queen’s Bench Justice Rick Saull admitted the penalty was much lighter than these types of crimes typically attract, and cautioned against this being used as a precedent.

The Crown conceded they may have had difficulty proving their case at trial because the incident began with a consensual sexual act but turned criminal when the young woman changed her mind.

Derksen, 35, who has no prior criminal record, admits picking the woman up in the North End and driving her outside of the city, where they began their sex-for-cash transaction.

The woman later told police she got "creeped" out by Derksen because he was being too rough and told him to stop.

He refused, ultimately kicking her out of his van and forcing her to run to neighbourhing home to call for help.

Derksen was arrested in 2008, when DNA seized during the crime proved to be a match to his.
