Driver found not guilty of dangerous driving causing death

A Winnipeg man has been found not guilty of dangerous driving causing death for a December 2008 crash that killed a 91-year-old Winnipeg woman.

 John Casanova, 41, walked free Monday after provincial court Judge Marvin Garfinkel ruled his level of driving didn't represent a "marked departure from the normal standard" exhibited by other motorists.

 Crown attorney John Barr said the evidence suggests Casanova was driving 104 km/h around the time of the crash at the intersection of St. Mary's Road and Regal Avenue. The elderly victim, Violet Gooding, was in a Pontiac Grand Am that crossed in front of Casanova's vehicle as she was making a turn, court was told.

 Barr said the judge ruled the Crown had met the legal test to prove civil liability -- but not criminal culpability. He said several witnesses had testified that other drivers routinely speed up in that area and Gooding's manner of driving would not have been abnormal.
