Farmers sue province over rural dam

A group of Manitoba farmers and ranchers is suing the province for damages and lost income over the operation of the Shellmouth Dam near the Saskatchewan border.

They've hired Charles Huband, a former Manitoba Appeal Court judge, to represent them in a case that could be heard as early as this spring.

The plaintiffs all own property immediately downstream from the dam and reservoir (Lake of the Prairies) in the RM of Shellmouth-Boulton.

In the lawsuit, they claim the operation of the dam has caused permanent damage to their land and prevented them from growing crops.

The suit claims the landowners suffered damages in 2006, 2007, 2010 and 2011.

Among the plaintiffs is Gene Nerbas, a former longtime municipal councillor for the area who has long complained about the dam's effects on local property owners.
