Fine for diverting prescriptions
A Winnipeg pharmacist has been disciplined for diverting prescriptions from the Zellers pharmacy that employed him to a business in which he had a financial interest.
The Manitoba Pharmaceutical Association recently fined Kaur Singh Sidhu $4,000 and ordered him to pay another $16,000 toward the cost of its investigation.
In the fall of 2010, Sidhu was a pharmacist at the Zellers pharmacy in the River East Plaza on Henderson Highway. The store would close the following January.
Sidhu, who now operates River East Pharmacy, also on Henderson Highway, contacted former Zellers pharmacy customers in early 2011 to have them transfer prescriptions to his new business. The MPA said he used the clients' personal health information to solicit business from the former Zellers customers in violation of the law.
The pharmaceutical association's disciplinary committee said that in September or October of 2010, as a pharmacist at Zellers, Sidhu also "transferred prescriptions for patients to another pharmacy or pharmacies in which he had or intended to have a direct or indirect financial interest and intentionally misidentified the pharmacy or pharmacies in the Zellers Pharmacy records in order to conceal the true destination of the transferred prescriptions."
Sidhu also failed to record the name of the pharmacy filling the prescriptions in breach of a pharmaceutical regulation.
Meanwhile, the MPA, the profession's regulatory body, also found Sidhu added refills to prescriptions for a patient identified in the discipline committee report as "HG" without obtaining authorization from the prescribing physician. The report, posted on the association's website, does not identify the prescription drugs.
The MPA found Sidhu -- who ran unsuccessfully for the Tories in last fall's general election -- guilty of professional misconduct.
Reached twice by phone at River East Pharmacy on Wednesday, Sidhu declined to comment, saying he was busy serving customers.
Ronald Guse, the pharmaceutical association's registrar, was unavailable for comment on Wednesday. Apart from the fines, the MPA did not appear to take any other action against Sidhu.
