Patient sues for hole cut in her colon at hospital

A St. Malo woman claims she endured unbearable pain after a hole was cut in her colon during abdominal surgery and not properly repaired.

Kim Bernshine claims that for the 10 days following the initial Feb. 24, 2011 surgery, she "languished in pain and suffering, lapsing in and out of consciousness and delirium, until her condition was finally recognized." As a result, Bernshine says "her life has been forever altered."

Bernshine recently initiated court action against St. Boniface General Hospital, where the surgery took place, several doctors and surgeons, a number of the nursing staff and the Winnipeg Regional Health Authority.

She is seeking unspecified general and special damages. The allegations have not been proven in court. Statements of defence have not been filed.

WRHA spokeswoman Heidi Graham said representatives of the hospital and health authority met with Bernshine, explained to her what happened and apologized for her experience. Graham said because the matter is now before the court, there will be no further comment.

In a statement of claim filed in Queen's Bench, Bernshine states she has suffered a loss of income and is unlikely to return to her job at the Canada Revenue Agency.

She said surgeons realized immediately her colon had been cut and sutured it, but she states that within a day or two, signs developed that indicated there was something wrong: spikes in blood pressure, temperature and pain levels, bouts of sweating and swelling of her abdomen.

A trial date has not been set.
