Two lawsuits filed against developer B&M Land

TWO companies have launched non-payment lawsuits against Winnipeg developer Andrew Marquess.

Brock White Canada filed a statement of claim in the Court of Queen's Bench last week that alleges Marquess's company, B&M Land, owes it $73,275 after B&M failed to pay monthly instalments on a promissory note. Court documents claim B&M Land agreed to pay Brock White Canada nine monthly instalments of $9,000. The company alleges they have so far received only $27,000.

IFC Canada Inc., also filed a lawsuit against B&M Land for non-payment last week, and claims the company has failed to pay it for an apartment-style trash compactor. In a statement of claim, IFC Canada alleges B&M Land ordered the trash compactor for 160 Smith St., in August 2010, and was supposed to pay for it within 30 days.

"IFC did not receive any payment from B&M in relation to the invoice or at all," the statement of claim said.

The company is seeking $14,644.

In both instances, no statement of defence has been filed and the allegations have not been proven in court.

Last year, city council voted to guarantee $10 million in loans to Marquess's other company, Gem Equities, to convert the Fort Rouge Yards into a 900-unit townhouse, condominium and commercial development alongside Jubilee Avenue.
