A judge in Dauphin tossed out charges of first-degree murder, sexual interference and aggravated sexual assault against a man accused of killing his ex-girlfriend’s three-year-old daughter. Jason Allen Kines was acquitted on those charges Monday after Justice Brian Midwinter agreed with a defence motion the jury could not convict beyond a reasonable doubt.
Kines was on trial for for his alleged role in the August 2006 slaying of Venecia Audy.
Midwinter gave a directed verdict of not guilty on the three charges, effectively taking the case out of the jury’s hands.
Kines had earlier pleaded guilty to not providing the necessities of life and will serve another 10 months in jail.
During the trial, Crown attorney Donovan Dvorak told jurors the little girl suffered a multitude of injuries while living with Kines and her mother, Melissa Audy, at their home in Bowsman, about 20 kilometres north of Swan River.
They include a fractured skull, lacerated liver, broken ribs, a spinal injury, numerous bruises throughout her body and several human bite marks, including a “skin-breaking” bite just above her vagina, Dvorak said in his opening statement in mid-February. The child was also undersized, weighing just 27 pounds.
Melissa Audy, 25, pleaded guilty in 2009 to failing to provide the necessities of life and was sentenced to one year in jail as part of a plea bargain between Crown and defence lawyers.
She was originally charged with second-degree murder, but that was dropped.
This case and several other deaths previously sparked a review of Manitoba’s child-welfare system.
