The Crown has stayed charges against a man accused in a fatal shooting in the Exchange District in 2022.

Tristan James Raynard Asham, 21, was shot on McDermot Avenue near Albert Street early Nov. 5, 2022.

Winnipeg police said the shooting occurred after a confrontation between two groups.

Shiv Austin Harper, a 20-year-old who Winnipeg homicide detectives identified as the alleged shooter, fled the province and was arrested in Langley, B.C. in June 2023. He was charged with second-degree murder and a firearms offence.

A spokesperson for the provincial Crown attorney’s office said prosecutors didn’t have enough evidence.

“After a thorough review of the evidence, it was determined that the Crown did not have a reasonable likelihood of conviction,” said the spokesperson.

Court records show the stays were entered on Feb. 7 on an administrative docket, meaning whatever evidence the Crown had was not discussed on the public record.

Asham’s death marked a grim new record of 45 people slain in Winnipeg in a year — at the time, it was the highest number of killings in a single year in city history. By year’s end, 53 people had been slain.
