Interim injunction to stop ‘anti-Semitic’ blogger put off until April 8

An attempt by two local businessmen brothers to silence a blogger has been put off for another day.

The application to the courts by Sandy and Robert Shindleman for an interim injunction stopping Gordon Warren from communicating in any way about them or their business, Shindico Realty, was adjourned to April 8.

The adjournment came about when Warren appeared at the morning hearing to oppose the application – the hearings are for matters that are unchallenged and the presiding judge refused to consider the application if there were going to be arguments.

Justice Donald Bryk said an injunction to stop Warren from communicating should only be given in exceptional circumstances and he wasn’t able or prepared to make an order like that this morning and would not be available to hear arguments this week.

That sent the Shindleman brothers’ lawyer, Robert Tapper, scurrying off to find another judge to hear arguments. Originally, the hearing was re-scheduled for Wednesday morning but that was changed hours later when it became apparent a judge would not be available. The hearing will now take place at 10 a.m. on April 8.

Warren has repeatedly accused the Shindleman brothers of being involved in a criminal conspiracy, along with Mayor Sam Katz and several other prominent business people, all but one who are Jewish. He has made the accusations on his Internet blog, on posters that were distributed in the downtown area and in emails.

The Shindlemans say Warren’s writings are defamatory and anti-Semitic.

The Shindlemans believe Warren will use the defamation claim against him to further attack them, adding they want an interim injunction until the defamation case is decided by the courts.

Warren told the Free Press outside court that he looked forward to the defamation court case, adding he denied the allegations and said he has not written anything that is defamatory or anti-Semitic.
