Winnipeg sex crime charges against former fashion executive Peter Nygard can’t move forward until after he goes to trial in Ontario, his defence team has suggested.

The Winnipeg charges appeared on an administrative docket Friday morning in a Manitoba court.

Neither Nygard, 82, nor his lawyer, Toronto-based Brian Greenspan, were required to be present. An associate with Greenspan’s law firm, Michelle Biddulph, asked for an adjournment by phone.

She said Nygard is scheduled to go to trial in Ontario this fall.

“Realistically, this matter in Winnipeg can’t move ahead until the Toronto trial is done,” she told the court.

Biddulph initially asked for the local case to resume in December, but the remand court only had authority to set the next court date for Sept. 22.

It’s likely Nygard’s defence team will seek a further extension before any substantial court appearance occurs on the local charges.

The Manitoba court heard Friday the case will be prosecuted by a Saskatchewan Crown attorney.

In July, the Winnipeg Police Service charged Nygard with sexual assault and forcible confinement, stemming from an alleged incident at his former company headquarters in November 1993.

He is currently in custody in Toronto, facing nine counts of sexual assault and three counts of forcible confinement for alleged incidents in the Ontario capital.

Nygard also faces two sex crime charges in Quebec, and nine sex-related charges in the United States.

None of the charges have been tested in court.
