A Manitoba judge has released police videotapes of officers trudging through snow in Fisher River, led by Karl McKay, to reach the site where Phoenix Sinclair was buried. The video was filmed at night on March 17, 2006.

 

"We are leaving the garbage dump road and Karl Wesley McKay is going to take us where Phoenix Sinclair is buried," an RCMP officer said in the video.

The video shows McKay walking around, using a flashlight to show police where Sinclair was buried. He got down on his knees and made a mark in the snow with his hand to show police precisely where she was buried.

"Yeah, that looks a little deeper in and I’m pretty sure I was about here," McKay said in the video, pointing to the spot he had just marked.

 

 

 

Court of Queen’s Bench Justice Karen Simonsen first rejected the media’s bid to access to the audio and videotaped interviews of Karl McKay and Samantha Kematch once they were shown to jurors, including McKay’s re-enactment of how he buried Phoenix’s body.

Despite no objections from Kematch or McKay’s lawyers, Simonsen ruled a fair trial might be compromised by excessive playing of the tapes by the media. However, she agreed to revisit the issue once jury deliberations began.
