A 49-year-old man who collapsed at the Manitoba Marathon has died.
Darrell Braun of Landmark, a father of four, had reportedly been in a coma since collapsing after entering University Stadium on Father’s Day. He died on Friday.
“The Manitoba Marathon is saddened by the passing of one of our participants,” said Manitoba Marathon executive director Shirley Lumb. “Our condolences to his family and friends.”
30-month term sought
THE Crown is seeking a 30-month prison sentence for a young man who committed a violent attack outside a Winnipeg high school last year.
The 19-year-old accused was found guilty at trial earlier this year of aggravated assault. He claimed he acted in self-defence when he kicked a 15-year-old boy in the head, causing a broken jaw that had to be wired shut for six weeks.
The victim and several friends had come to Kelvin High School as “muscle” to protect a young female student from the unwanted advances of another boy at the school — the younger brother of the man now before the courts. There had been a heated confrontation inside the cafeteria during lunch, and plans were made for an afterschool brawl.
The boy with the broken jaw admits he brought a machete. He claims he only planned to use it to frighten people and never intended any harm.
Kimberly Gauthier, a vice-principal at Kelvin, told court she came outside to see the accused holding the machete while the victim was down and injured. She recognized the accused as a former student. Gauthier demanded he turn over the knife and called police.
Provincial court Judge Marva Smith rejected self-defence claim.”The force he used… was far more than necessary and was excessive… and unjustified,” Smith wrote in her decision.
Crown attorney Chris Vanderhooft argued Monday that a penitentiary sentence is needed for the accused. The man’s lawyer requested a conditional sentence that allows her client to remain free in the community. Smith has reserved her decision until Aug. 5.
Decision appealed
A group of River Heights residents has appealed another city decision to allow an Academy Road restaurant to have a patio.
On May 15, the Board of Adjustment approved an application by J.Fox’s Restaurant & Local serve customers on a 24-seat streetfront patio between the hours of 11 a.m. and 11 p.m., as long as there is no amplified music and all alcohol will be served with food.
Four area residents have appealed the patio on the basis of parking and noise concerns.
A public hearing is slated for Thursday at city hall.
Cops release sketch
POLICE have released the sketch of a man wanted in connection with the June 8 sexual assault of a 16-year-old at a downtown mall.
The young woman was at Portage Place at about 6:45 p.m. Monday, June 8 and met several unknown males. A short time later, one of the males asked her to go for a walk and she agreed. The man led her to a stairwell inside the mall and she was sexually assaulted. The victim fled and notified security, who called police.
The man is described as aboriginal in appearance, late teens, 5’8″, average build, with piercings in his right ear, right eyebrow, and tongue. He was wearing a grey hoodie with a burgundy and yellow design around the collar, and baggy dark pants.
The sex crimes unit is investigating. Anyone with information regarding the incident or identity of the suspect is asked to contact investigators at 986-6245 or CrimeStoppers at 786-TIPS (8477).
