A teen who was sentenced as an adult for brutally attacking two women on Winnipeg streets nearly three years ago has been ordered to serve his sentence in a federal prison.

Robert McKay, now 19, has more than 12 years left behind bars. He pleaded guilty to two counts of aggravated sexual assault for the crimes, which occurred Nov. 7 and 8, 2014, when he went out with his cousin, then-20-year-old Justin Hudson, to celebrate his 17th birthday.

Court of Queen’s Bench Justice Gerald Chartier made the order after a brief hearing Monday.

Crown attorney Jennifer Comack argued in favour of placing McKay in an adult facility, citing recommendations from probation officers in a placement report that has been filed as an exhibit in court but has not been publicly released.

No motion has yet been filed to restrict access to court documents in this case, including a pre-sentence report in which McKay was interviewed by a probation officer. The judge granted a request, however, from McKay’s defence lawyer, Tara Walker, to “hold” the documents for 30 days — until a lawyer for Child and Family Services has a chance to formally request the documents be redacted because of a concern they may contain private information about CFS records.

Because McKay was sentenced as an adult even though he was a youth at the time, the court still had to decide where he should serve his sentence. In August, he was sentenced to a total of 17 years and given credit for the time he’s already spent in custody.

In the early hours of Nov. 8, 2014, Hudson and McKay walked along city streets, initially with a plan to break into cars. They chose victims at random, however, raping and robbing a 23-year-old woman and a 16-year-old girl, who was left for dead in the freezing Assiniboine River.

The victims can’t be identified under a publication ban.

Hudson was sentenced to 23 years in prison.
