RIVER East Transcona School Division is suing two teens — and their parents — for breaking into and damaging a local elementary school over the summer break.
The teens, the school division alleges in a recently filed lawsuit, forced their way into Bird’s Hill School in East St. Paul during the summer in 2022, and broke windows and computers, splattered paint and set off a fire extinguisher.
The elementary school has about 200 students enrolled from kindergarten to Grade 5, according to the division.

Winnipeg law firm Fillmore Riley LLP filed the school division’s statement of claim on behalf of its insurance company on Oct. 3 in Manitoba Court of King’s Bench.
The suit names the two teen boys, as well as their parents, as defendants; no statements of defence have been filed in response to the allegations.
The Free Press is not naming the teens — who were underage at the time of the alleged damage — or their parents. It is unclear, based on the legal documents, how old the pair are currently.
The teens, it is alleged, went to the elementary school at 3950 Raleigh St. in East St. Paul after hours on July 4, 2022 and forced entry into the building.
“Some furniture, school supplies, books, electronics and other items belonging to the school were covered in paint and/or broken glass, or were otherwise (damaged) and required cleaning, repairs or replacement,” the legal filings say.
The teenagers’ actions caused the division to lose money in cleaning, repairing and replacing the damaged building and its contents, the suit contends.
The division’s insurance firm argues the parents were negligent by failing to supervise the teens reasonably and failing to prevent them from damaging school property.

The lawsuit is relying on the provincial Public Schools Act to hold the parents responsible for the damage.
The legislation dictates that if property of a school division is destroyed, damaged, lost or converted by the intentional or negligent act of a child, that child and their parents or legal guardians are liable for the loss.
The lawsuit is seeking $21,060 in repair costs and $2,216 for damaged and destroyed items, as well as interest and costs.
